DOL Updates FMLA Forms graphic Earlier this month, the U.S. Department of Labor’s (DOL) Wage and Hour Division released updated Family Medical Leave Act (FMLA) forms. The DOL forms are designed to meet employer’s requirements for providing certain notices to employees (such as notices of eligibility, rights and responsibilities, and employer’s designation of leave) and for requesting medical or military certification of the need for leave. The updated forms may be found and downloaded from the DOL’s website.

Tennessee employers subject to the FMLA should begin using the new forms immediately. However, there’s no harm in inadvertent delay, since the new forms are identical to the previous version, but for the new expiration date (August 31, 2021) in the upper right corner. Employers using their own forms should take this opportunity to review their forms and ensure that they contain the same information as the DOL’s forms, are clear and understandable, and do not conflict with the FMLA.
